Anyday Raceday Participant Waiver and
Release of Liability
PLEASE READ CAREFULLY. THIS AGREEMENT INCLUDES AN ASSUMPTION OF RISK AND RELEASE OF CERTAIN LEGAL RIGHTS.
By registering for or participating in an Anyday Raceday virtual race, run, walk, challenge, or related activity (each an “Event”), I acknowledge and agree to the following:
1. Voluntary Participation
I understand that participation in an Anyday Raceday Event is entirely voluntary. I am responsible for determining whether I am physically capable of participating and for choosing a distance, pace, route, location, date, and time appropriate for my abilities and circumstances.
2. Virtual and Self-Directed Event
I understand that Anyday Raceday Events are virtual and self-directed. Anyday Raceday does not designate, inspect, approve, supervise, or control the route or location where I participate.
Unless expressly stated otherwise for a particular Event, Anyday Raceday does not provide course monitoring, road closures, traffic control, security, hydration stations, medical personnel, emergency services, or on-course assistance.
I am solely responsible for choosing a reasonably safe route and location, obeying traffic and pedestrian laws, remaining aware of my surroundings, and determining whether weather, lighting, traffic, road, trail, or other conditions are appropriate for participation.
3. Acknowledgment and Assumption of Risk
I understand that running, walking, and other physical activities involve inherent and other risks that may result in injury, illness, property damage, permanent disability, or death.
These risks may include, but are not limited to, falls; uneven or hazardous surfaces; traffic; vehicles; bicycles; other pedestrians or runners; road and trail conditions; darkness or limited visibility; weather; heat or cold; animals; dehydration; overexertion; equipment failure; and cardiovascular, muscular, orthopedic, or other medical events.
I knowingly and voluntarily accept and assume the risks associated with my participation in an Event, whether known or unknown, foreseeable or unforeseeable, to the fullest extent permitted by law.
4. Health and Medical Responsibility
I am responsible for determining whether I am medically and physically able to participate safely. Anyday Raceday does not provide medical advice or determine whether participation is appropriate for any individual.
I agree to use reasonable judgment and to stop participating if I experience pain, dizziness, difficulty breathing, unusual weakness, or other symptoms that may indicate that continuing could be unsafe. I am responsible for obtaining medical advice before participating when appropriate.
I understand that emergency or medical assistance may not be immediately available while I participate.
5. Personal Safety
I understand that my safety remains my responsibility throughout the Event. I agree to use reasonable care when selecting and completing my route and to comply with applicable laws and regulations.
If I choose to participate with another person, a child, a pet, or an animal, I accept responsibility for determining whether doing so is safe and appropriate and for complying with applicable laws and safety requirements.
6. Release and Waiver of Liability
In consideration for being permitted to participate in an Anyday Raceday Event, I, on behalf of myself and, to the extent permitted by law, my heirs, estate, personal representatives, successors, and assigns, release and discharge Anyday Raceday and its owners, officers, employees, contractors, agents, affiliates, sponsors, partners, and representatives (collectively, the “Released Parties”) from claims for personal injury, illness, death, property damage, or other loss arising out of or related to my participation in an Event, including claims resulting from the ordinary negligence of a Released Party, to the fullest extent permitted by applicable law.
This release does not apply to claims or liability that cannot legally be waived or released.
7. Covenant Not to Sue
To the fullest extent permitted by law, I agree not to bring a claim or lawsuit against the Released Parties for matters that I have released under this Agreement.
8. Personal Property and Expenses
I am responsible for my personal property, equipment, transportation, medical expenses, and other costs associated with my participation. Anyday Raceday is not responsible for lost, stolen, or damaged personal property except to the extent required by law.
9. Participants Under 18
A participant under 18 may participate only with the permission of a parent or legal guardian.
By registering a minor, the parent or legal guardian confirms that they have read and understand this Agreement, consent to the minor’s participation, accept responsibility for determining whether the Event is appropriate for the minor, and agree to provide appropriate supervision.
The parent or legal guardian also accepts and assumes, on their own behalf, the risks associated with the minor’s participation and releases any claims belonging to the parent or legal guardian arising from the minor’s participation to the fullest extent permitted by law.
Nothing in this section is intended to waive or release a minor’s rights where such rights cannot legally be waived by a parent or legal guardian.
10. Electronic Acceptance
By checking the acceptance box during registration and completing my registration, I acknowledge that I have had the opportunity to read this Agreement, understand that it affects legal rights, and voluntarily agree to its terms.
If I am registering a minor, I confirm that I am the minor’s parent or legal guardian and am authorized to provide the consent described above.
11. Severability
If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
12. Acknowledgment
I acknowledge that I have read this Participant Waiver and Release of Liability, understand its terms, understand that I am giving up certain legal rights, and voluntarily agree to be bound by it.
