TERMS & CONDITIONS, PARTICIPANT WAIVER, ASSUMPTION OF RISK, RELEASE OF LIABILITY AND ARBITRATION AGREEMENT

IMPORTANT: PLEASE READ THIS AGREEMENT CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

These Terms & Conditions, Participant Waiver, Assumption of Risk, Release of Liability and Arbitration Agreement (“Terms”) govern your use of the Anyday Raceday website, registration for or purchase of any Anyday Raceday virtual race, challenge or event, purchase of related products or services, and participation in any related activity.

By accessing the website, purchasing or registering for an event, checking a box indicating acceptance, submitting a registration, or participating in an Anyday Raceday event, you acknowledge that you have read, understood and voluntarily agree to be legally bound by these Terms.

For purposes of these Terms, “Anyday Raceday,” “Company,” “we,” “our,” and “us” mean Anyday Raceday LLC, together with its owners, members, managers, officers, employees, agents, contractors, affiliates, representatives, successors and assigns.

1. NATURE OF ANYDAY RACEDAY EVENTS

Anyday Raceday provides virtual races, running and walking challenges, fitness challenges and related products and services.

Anyday Raceday events are virtual events and are not organized, supervised or closed-course physical races unless expressly stated otherwise.

Participants generally choose their own:

  • Location
  • Route
  • Date and time
  • Distance, where options are provided
  • Pace
  • Method of completing the event
  • Weather conditions
  • Road, sidewalk, trail or other surface
  • Equipment
  • Hydration and nutrition
  • Safety precautions

Anyday Raceday does not inspect, approve, supervise, monitor or control the location or route selected by a participant.

There may be no race officials, traffic control, police protection, course markings, aid stations, medical personnel, hydration stations or other support normally associated with an organized in-person race.

YOU ARE SOLELY RESPONSIBLE FOR SELECTING A SAFE LOCATION, ROUTE, DATE, TIME AND METHOD FOR COMPLETING YOUR EVENT.

2. VOLUNTARY PARTICIPATION AND ASSUMPTION OF RISK

Running, walking, hiking and other physical activities involve inherent and potentially serious risks.

These risks include, but are not limited to:

  • Falls, slips and collisions
  • Uneven pavement, trails, potholes and other surface conditions
  • Vehicle and bicycle traffic
  • Pedestrians and other runners
  • Animals, insects and wildlife
  • Heat, cold, humidity, rain, snow, ice, lightning and other weather conditions
  • Dehydration and electrolyte imbalance
  • Exhaustion and overexertion
  • Muscle, tendon, ligament, bone and joint injuries
  • Illness
  • Heat exhaustion and heat stroke
  • Hypothermia
  • Cardiac events
  • Equipment failure
  • Crime or actions of third parties
  • Running or walking alone
  • Running or walking during darkness or reduced visibility
  • Getting lost
  • Lack of immediate medical assistance
  • Serious bodily injury
  • Permanent disability
  • Paralysis
  • Death

You knowingly and voluntarily accept and assume all risks, known and unknown, foreseeable and unforeseeable, associated with your participation.

Participation is entirely voluntary.

3. PARTICIPANT HEALTH, MEDICAL CLEARANCE AND RESPONSIBILITY

Participation in running, walking, hiking and other physical activities can involve strenuous physical exertion and may present risks of serious injury, illness, cardiac events, disability or death.

BEFORE PARTICIPATING IN AN ANYDAY RACEDAY EVENT OR BEGINNING OR CHANGING AN EXERCISE PROGRAM, PARTICIPANTS SHOULD CONSULT WITH THEIR PHYSICIAN OR OTHER QUALIFIED HEALTHCARE PROFESSIONAL TO DETERMINE WHETHER PARTICIPATION IS APPROPRIATE FOR THEIR INDIVIDUAL HEALTH AND PHYSICAL CONDITION.

This is particularly important for anyone who has a known medical condition, has experienced chest pain, dizziness, fainting, shortness of breath or other concerning symptoms, has been advised to limit physical activity, is pregnant, is recovering from an injury or illness, takes medications that may affect exercise, or otherwise has concerns regarding their ability to safely participate.

By participating, you acknowledge and agree that:

  • You are solely responsible for determining whether you are physically and medically capable of participating.
  • You are responsible for obtaining appropriate medical advice or clearance before participating.
  • You will not participate if you have been advised by a physician or qualified healthcare professional not to participate.
  • You will stop participating and seek appropriate medical attention if you experience chest pain, unusual shortness of breath, dizziness, fainting, severe pain, confusion or other symptoms indicating a possible medical emergency or unsafe condition.
  • You are responsible for selecting an activity, distance, pace, route and conditions appropriate for your abilities and health.

Anyday Raceday does not evaluate participants’ medical conditions or fitness levels and does not determine whether an individual is capable of safely completing an event.

Anyday Raceday does not provide medical advice, medical screening, diagnosis, treatment, rehabilitation services or individualized medical or training recommendations.

Any health, fitness, running, walking, hydration, nutrition, training or safety information provided through Anyday Raceday is provided solely for general informational purposes and is not intended to replace professional medical advice, diagnosis or treatment.

Never disregard professional medical advice or delay seeking medical care because of information provided by Anyday Raceday.

IF YOU HAVE ANY QUESTION OR CONCERN ABOUT WHETHER YOU CAN SAFELY PARTICIPATE, CONSULT YOUR PHYSICIAN OR OTHER QUALIFIED HEALTHCARE PROFESSIONAL BEFORE PARTICIPATING.

Because Anyday Raceday events are virtual, Anyday Raceday does not provide or guarantee on-site medical personnel, emergency services, first aid or medical assistance.

You acknowledge that emergency medical assistance may not be immediately available depending upon the location and route you select.

To the fullest extent permitted by law, you are responsible for medical expenses and other costs resulting from your participation.

4. PARTICIPANT SAFETY RESPONSIBILITIES

Participants are responsible for exercising reasonable judgment and following applicable laws and safety practices.

You agree to obey traffic laws, pedestrian rules, property restrictions, park and trail rules and all other applicable laws and regulations.

You should not participate under conditions that you reasonably believe are unsafe.

Participants are responsible for:

  • Selecting an appropriate and reasonably safe route
  • Remaining aware of traffic and surroundings
  • Wearing appropriate clothing and footwear
  • Using reflective or visibility equipment when appropriate
  • Carrying adequate hydration and nutrition
  • Avoiding dangerous weather conditions
  • Carrying identification and emergency contact information when appropriate
  • Informing another person of their route or expected return when appropriate
  • Obtaining permission before entering private property

Anyday Raceday does not guarantee that any route, location or activity suggested or shared by another person is safe.

5. RELEASE AND WAIVER OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU, ON BEHALF OF YOURSELF AND YOUR HEIRS, ESTATE, PERSONAL REPRESENTATIVES, EXECUTORS, ADMINISTRATORS, SUCCESSORS AND ASSIGNS, VOLUNTARILY RELEASE, WAIVE AND DISCHARGE ANYDAY RACEDAY AND THE RELEASED PARTIES FROM CLAIMS ARISING OUT OF OR RELATING TO YOUR PARTICIPATION IN AN EVENT.

“Released Parties” includes Anyday Raceday LLC and its current and former owners, members, managers, officers, employees, contractors, agents, affiliates, representatives, vendors, sponsors, charitable organizations, beneficiaries, service providers, successors and assigns, to the fullest extent permitted by applicable law.

This release includes claims involving personal injury, illness, property damage, economic loss, disability or death arising from or relating to participation in an event, including claims arising from the ordinary negligence of a Released Party to the extent such claims may lawfully be released.

This release applies to risks associated with route selection, traffic, weather, surfaces, other individuals, animals, equipment, hydration, medical conditions and the absence or delay of emergency assistance.

Nothing in these Terms is intended to waive or limit liability that cannot legally be waived or limited under applicable law.

6. COVENANT NOT TO SUE

To the fullest extent permitted by law, you agree not to initiate or maintain a lawsuit or other proceeding against a Released Party concerning a claim that you have released under these Terms.

This provision does not prohibit you from pursuing a claim that applicable law does not permit you to waive.

7. INDEMNIFICATION

To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless Anyday Raceday and the Released Parties from third-party claims, damages, liabilities, judgments, losses, costs and reasonable attorneys’ fees arising out of or relating to:

  1. Your participation in an event;
  2. Your violation of these Terms;
  3. Your violation of applicable law;
  4. Your infringement of another person’s rights;
  5. Your actions or omissions while participating; or
  6. A claim arising from another individual whom you registered or permitted to participate through your registration, to the extent permitted by law.

8. CHARITABLE GIVING AND ORGANIZATIONAL SUPPORT

ANYDAY RACEDAY LLC IS A FOR-PROFIT BUSINESS AND IS NOT A NONPROFIT OR TAX-EXEMPT CHARITABLE ORGANIZATION.

Anyday Raceday may choose to donate or distribute a portion of revenue, proceeds or other funds associated with certain races, campaigns or business activities to charitable organizations, nonprofit organizations, community organizations, schools, causes or other organizations selected by Anyday Raceday.

Unless expressly stated otherwise for a particular event, Anyday Raceday retains discretion to determine the recipient organization or organizations and the amount, percentage, calculation method and timing of any distribution.

Anyday Raceday may determine:

  • Which organization or organizations receive funds
  • The amount or percentage distributed
  • The method used to calculate the distribution
  • The timing of distributions
  • Whether funds are divided among multiple organizations
  • Whether a substitute organization should be selected if an intended recipient becomes unavailable, ineligible, unresponsive or otherwise unsuitable
  • How charitable and community-support programs are administered

The amount distributed may be based on registration revenue, proceeds, profits, a fixed amount per registration or another method disclosed by Anyday Raceday.

A RACE REGISTRATION OR PURCHASE FROM ANYDAY RACEDAY IS A PURCHASE FROM A FOR-PROFIT BUSINESS AND SHOULD NOT BE ASSUMED TO BE A TAX-DEDUCTIBLE CHARITABLE DONATION.

Any separately identified donation will be handled according to the disclosures presented at the time of the transaction.

Anyday Raceday makes no representation or warranty regarding the tax deductibility of any registration fee, purchase, donation or other payment. Participants should consult their own tax adviser regarding tax consequences.

Unless expressly stated in writing, identification of a charity or organization does not mean that the organization sponsors, operates, endorses, controls or assumes responsibility for an Anyday Raceday event.

Recipient organizations are not responsible for participant safety, event administration, fulfillment, refunds, injuries or claims associated with an Anyday Raceday event.

Anyday Raceday may change a designated recipient when reasonably necessary and may instead distribute applicable funds to another organization, including an organization with a similar mission or purpose.

9. NO GUARANTEE OF CHARITABLE AFFILIATION

Use of an organization’s name solely to identify an intended beneficiary does not create a partnership, joint venture, agency, sponsorship or endorsement relationship.

Anyday Raceday will not knowingly represent an organization as an official partner or sponsor unless such a relationship has been authorized.

10. REGISTRATION FEES, PRODUCTS AND FULFILLMENT

Registration may include physical or digital items such as shirts, medals, downloadable certificates or other merchandise as described on the applicable event page.

Product photographs, mockups and illustrations are representative. Actual products may vary in color, size, material, design, dimensions, packaging or appearance because of manufacturing availability or other reasonable business considerations.

Anyday Raceday may substitute an item with an item of reasonably comparable type or value if the originally planned item becomes unavailable.

Participants are responsible for providing accurate registration, sizing, contact and shipping information.

Anyday Raceday is not responsible for problems or delays caused by inaccurate information supplied by a customer.

11. APPAREL SIZING

Participants are responsible for selecting their apparel size.

Sizing may vary among manufacturers, brands and products. Any sizing information provided by Anyday Raceday is intended as a general guide and does not guarantee fit.

Unless otherwise required by law or expressly stated, apparel ordered in the size selected by the participant is not considered defective merely because it does not fit as expected.

12. SHIPPING AND DELIVERY

Shipping and delivery dates are estimates and are not guarantees.

Anyday Raceday is not responsible for delays caused by carriers, severe weather, natural disasters, labor disruptions, customs, supply-chain disruptions or circumstances outside its reasonable control.

Participants are responsible for providing a complete and accurate shipping address.

Additional charges may apply if an order must be reshipped because the participant supplied an incorrect or incomplete address.

Risk of loss and other shipping rights will be determined in accordance with applicable law.

13. REFUNDS, CANCELLATIONS AND TRANSFERS

Except where otherwise required by law or expressly stated in a specific event’s refund policy, race registrations are final and nonrefundable once processed.

Because merchandise and event materials may be ordered, produced or allocated based upon registration, a participant’s failure or inability to complete an event does not automatically entitle the participant to a refund.

Anyday Raceday may, in its discretion, provide a replacement, credit, transfer or refund in unusual circumstances. Providing such a remedy in one situation does not create an obligation to provide the same remedy in another.

Shipping charges, processing fees and separately designated donations may be nonrefundable to the fullest extent permitted by law.

Nothing in this section limits rights that cannot legally be waived under applicable consumer-protection law.

14. EVENT MODIFICATION, POSTPONEMENT OR CANCELLATION

Anyday Raceday may modify, postpone, extend, shorten, replace, suspend or cancel an event when reasonably necessary because of safety concerns, supply problems, legal requirements, technical problems or circumstances beyond our reasonable control.

Because virtual events generally provide flexibility regarding when and where participants complete them, changes to promotional dates or suggested completion periods do not necessarily prevent participation.

Remedies for a canceled event, if any, will be determined by Anyday Raceday subject to applicable law.

15. RESULTS, TIMES AND COMPLETION CERTIFICATES

Unless expressly stated otherwise, Anyday Raceday events are recreational virtual events and are not certified competitive races.

Anyday Raceday may permit participants to submit completion times, distances, photographs or other evidence of participation.

Anyday Raceday does not independently verify or guarantee the accuracy of participant-submitted results.

Completion certificates, medals and similar recognition indicate participation or reported completion and do not constitute independently verified athletic records.

Anyday Raceday may reject, correct or remove results that reasonably appear fraudulent, inaccurate, abusive or inconsistent with event requirements.

16. NO GUARANTEE OF RESULTS

Anyday Raceday makes no representation or guarantee that participation in an event, challenge or activity will result in weight loss, improved health, improved race performance, increased fitness or any other particular result.

Individual results vary.

17. PARTICIPATION BY MINORS

A participant under 18 years of age may participate only with the consent and supervision required by applicable law.

A parent or legal guardian registering a minor represents that they have legal authority to do so and agrees, to the fullest extent permitted by law, to these Terms on behalf of themselves and the minor.

Parents and guardians are responsible for determining whether an activity, distance, route and conditions are appropriate and safe for the minor.

Parents and guardians should consult the minor’s physician or qualified healthcare professional when appropriate before allowing the minor to participate.

Nothing in these Terms attempts to waive a minor’s rights where such a waiver is prohibited by applicable law.

18. REGISTERING ANOTHER PERSON

If you register another individual, you represent that you have authority to provide the registration information.

Each competent adult participant should review and accept the applicable Participant Waiver and Terms before participating.

You may not accept a liability waiver on behalf of another competent adult unless legally authorized to do so.

19. PHOTOS, REVIEWS AND USER-SUBMITTED CONTENT

If you voluntarily submit, upload, tag, transmit or directly provide photographs, videos, race stories, testimonials, reviews, results or other content to Anyday Raceday for publication, you represent that you have the right to provide that content.

You grant Anyday Raceday a nonexclusive, worldwide, royalty-free license to reproduce, display, distribute, adapt for formatting and use that submitted content in connection with operating and promoting Anyday Raceday, its website, social media accounts, advertising and events, subject to applicable law and our Privacy Policy.

This provision does not transfer ownership of your underlying content to Anyday Raceday.

20. INTELLECTUAL PROPERTY

The Anyday Raceday name, logos, event names, graphics, website content, race artwork, medal designs, certificates and other proprietary materials are owned by or licensed to Anyday Raceday and are protected by applicable intellectual-property laws.

Content may not be reproduced, sold, distributed, copied or commercially exploited without prior written permission except as permitted by law.

21. WEBSITE AND THIRD-PARTY SERVICES

Our website and operations may rely upon third-party services including payment processors, ecommerce providers, hosting providers, shipping carriers, analytics services, social-media platforms and other technology or service providers.

Anyday Raceday does not control third-party services and is not responsible for outages, errors, delays, security incidents or actions of third parties except to the extent required by applicable law.

Links to third-party websites are provided for convenience and do not necessarily constitute endorsement.

22. WEBSITE AVAILABILITY

Anyday Raceday does not guarantee uninterrupted or error-free access to its website or online services.

We may modify, suspend or discontinue website functionality for maintenance, security, operational or business reasons.

23. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE, EVENTS, PRODUCTS, SERVICES AND RELATED MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

ANYDAY RACEDAY DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, EXCEPT TO THE EXTENT SUCH WARRANTIES CANNOT LEGALLY BE DISCLAIMED.

Anyday Raceday does not guarantee any particular athletic, fitness, medical, health or other outcome.

24. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANYDAY RACEDAY AND THE RELEASED PARTIES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THE WEBSITE, PRODUCTS, SERVICES OR EVENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF ANYDAY RACEDAY ARISING FROM A PARTICULAR REGISTRATION, PURCHASE OR EVENT WILL NOT EXCEED THE AMOUNT ACTUALLY PAID BY THE PARTICIPANT TO ANYDAY RACEDAY FOR THE REGISTRATION, PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

These limitations do not apply where prohibited by law.

25. INFORMAL DISPUTE RESOLUTION REQUIRED BEFORE ARBITRATION

Before commencing arbitration or other permitted legal proceedings, you and Anyday Raceday agree to attempt in good faith to resolve the dispute informally.

The party raising the dispute must provide written notice describing:

  • The person’s name and contact information
  • The transaction or event involved
  • The nature and factual basis of the dispute
  • The requested resolution

The parties will have 30 days after receipt of the notice to attempt to resolve the dispute informally before arbitration may be initiated, unless applicable law requires otherwise.

26. BINDING INDIVIDUAL ARBITRATION

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHT TO GO TO COURT.

Except for disputes that legally cannot be arbitrated and eligible individual claims brought in small claims court, any dispute, claim or controversy arising out of or relating to these Terms, an Anyday Raceday event, registration, purchase, product, service or relationship with Anyday Raceday that is not resolved through the informal dispute process shall be resolved through binding individual arbitration rather than a lawsuit in court.

The arbitration shall be administered by the American Arbitration Association (“AAA”) under the applicable consumer arbitration rules then in effect, unless the parties mutually agree to another arbitration provider.

The Federal Arbitration Act will govern the interpretation and enforcement of this arbitration provision to the extent applicable.

The arbitrator may award any individual remedy that would otherwise be available in court, subject to these Terms and applicable law.

Nothing in this section prevents either party from seeking appropriate temporary or emergency injunctive relief when permitted by law.

27. CLASS ACTION AND JURY TRIAL WAIVER

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND ANYDAY RACEDAY AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE ACTION.

Neither party may serve as a class representative or participate as a class member in an arbitrated claim covered by this provision.

TO THE EXTENT A DISPUTE IS PERMITTED TO PROCEED IN COURT RATHER THAN ARBITRATION, YOU AND ANYDAY RACEDAY KNOWINGLY AND VOLUNTARILY WAIVE THE RIGHT TO A TRIAL BY JURY TO THE FULLEST EXTENT PERMITTED BY LAW.

28. SMALL CLAIMS COURT

Notwithstanding the arbitration provisions above, either party may bring an individual action in an appropriate small claims court if the claim qualifies and remains solely on an individual basis.

29. GOVERNING LAW AND VENUE

Except where federal law controls or applicable consumer law requires otherwise, these Terms and any dispute arising from them will be governed by the laws of the State of Ohio, without regard to conflict-of-law principles.

For disputes that are not subject to arbitration and cannot properly be brought in small claims court, the parties consent to jurisdiction and venue in an appropriate state or federal court located in Ohio, subject to applicable law.

30. ELECTRONIC AGREEMENT AND SIGNATURE

You agree that checking an acceptance box, clicking an acceptance button, completing registration after being presented with these Terms, or otherwise electronically accepting these Terms constitutes your electronic signature and agreement.

Electronic records showing the date, time, order and version of the Terms accepted may be retained and used to demonstrate your agreement.

31. PRIVACY

Collection and use of personal information are also governed by the Anyday Raceday Privacy Policy.

Participants are responsible for reviewing the Privacy Policy before providing personal information.

32. FRAUD, MISUSE AND TERMINATION

Anyday Raceday may refuse, suspend or terminate participation, orders or access to its services where it reasonably believes there has been fraud, abuse, harassment, unauthorized commercial activity, manipulation of results, violation of these Terms or unlawful conduct.

Anyday Raceday reserves all rights and remedies available under applicable law.

33. FORCE MAJEURE

Anyday Raceday will not be responsible for delay or failure to perform caused by circumstances outside its reasonable control, including natural disasters, severe weather, epidemics, pandemics, government action, war, civil unrest, labor disruptions, transportation interruptions, carrier delays, supplier failures, utility failures or widespread internet or technology outages, subject to applicable law.

34. SEVERABILITY

If any provision of these Terms is determined to be invalid, illegal or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary, and the remaining provisions will continue in effect.

35. NO WAIVER

Anyday Raceday’s failure to enforce any provision of these Terms does not waive its right to enforce that provision or any other provision later.

36. ASSIGNMENT

You may not assign your rights or obligations under these Terms without Anyday Raceday’s written consent.

Anyday Raceday may assign these Terms in connection with a merger, acquisition, sale of assets, restructuring or transfer of its business, subject to applicable law.

37. CHANGES TO THESE TERMS

Anyday Raceday may revise these Terms from time to time.

Updated Terms will be posted with a revised “Last Updated” date. Material changes will apply prospectively as required by applicable law.

The version accepted in connection with a registration will govern that registration to the extent required by law.

38. ENTIRE AGREEMENT

These Terms, together with applicable event-specific terms, the Privacy Policy, refund policy and other policies expressly incorporated by reference, constitute the agreement between you and Anyday Raceday concerning the subject matter addressed herein.

If event-specific terms conflict with these general Terms, the event-specific terms will control solely with respect to that event to the extent expressly stated.

39. ACKNOWLEDGMENT AND ACCEPTANCE

BY REGISTERING, PURCHASING OR PARTICIPATING, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND THESE TERMS.

I UNDERSTAND THAT PARTICIPATION IN RUNNING, WALKING AND OTHER PHYSICAL ACTIVITIES INVOLVES RISKS OF SERIOUS INJURY, ILLNESS, PERMANENT DISABILITY AND DEATH. I KNOWINGLY AND VOLUNTARILY ASSUME THOSE RISKS.

I UNDERSTAND THAT I AM RESPONSIBLE FOR DETERMINING WHETHER I AM PHYSICALLY AND MEDICALLY CAPABLE OF PARTICIPATING AND THAT I SHOULD CONSULT MY PHYSICIAN OR OTHER QUALIFIED HEALTHCARE PROFESSIONAL BEFORE PARTICIPATING OR BEFORE BEGINNING OR CHANGING AN EXERCISE PROGRAM.

I UNDERSTAND THAT ANYDAY RACEDAY DOES NOT SELECT, INSPECT, CONTROL OR SUPERVISE THE ROUTE OR LOCATION WHERE I CHOOSE TO COMPLETE A VIRTUAL EVENT AND THAT I AM RESPONSIBLE FOR MY OWN SAFETY.

I UNDERSTAND THAT THESE TERMS CONTAIN A RELEASE AND WAIVER OF LIABILITY, COVENANT NOT TO SUE, INDEMNIFICATION OBLIGATIONS, LIMITATIONS OF LIABILITY, BINDING ARBITRATION AGREEMENT, CLASS ACTION WAIVER AND JURY TRIAL WAIVER THAT AFFECT MY LEGAL RIGHTS.

I UNDERSTAND THAT ANYDAY RACEDAY LLC IS A FOR-PROFIT BUSINESS AND NOT A NONPROFIT OR TAX-EXEMPT CHARITABLE ORGANIZATION, EVEN WHEN ANYDAY RACEDAY DISTRIBUTES A PORTION OF REVENUE, PROCEEDS OR OTHER FUNDS TO CHARITABLE, NONPROFIT OR COMMUNITY ORGANIZATIONS.

By electronically accepting these Terms, I confirm that I am legally capable of entering into this Agreement and voluntarily agree to be bound by it.
